Australia withdraws countervailing duty on aluminium extrusions imported from VietNam

Australian Department of Industry, Innovation and Science, through its Anti-Dumping Commission (ADC), issued a document to terminate part of an investigation on alleged dumping and subsidisation of aluminium extrusions imported from VietNam and Malaysia.

The ADC determined that Vietnamese producers had either not received any subsidy from the Government of VietNam for the products under investigation, or had received a negligible level of countervailable subsidy. This led the ADC to terminate the anti-subsidy investigation with VietNam.

In August 2016, ADC started an investigation into dumping and countervailing duty on aluminium extrusions imported from VietNam and Malaysia.  According to the Statement of Essential Facts, published by the ADC, preliminary countervailing margins for co-operative entities in the investigation process was set at 6.9-17.5 per cent and margins for non-cooperative entities at 34.9 per cent

After the investigation Capral Limited, a manufacturer of aluminium extrusions in Australia, lodged an application alleging that the goods had been exported from VietNam and Malaysia to Australia at prices less than their standard value as they received countervailing subsidies from the respective governments.

The investigation examined exports during the period from July 1, 2015 to June 30, 2016, to determine dumping or subsidisation allegations. Details of the Australian market were examined from July 1, 2012 to find out any possible business injury.

Capral said the estimated dumping margins of Vietnamese products were at 10.19 per cent, while the subsidy margin for exports was negligible. It also alleged that dumping and subsidisation had caused material injury to the Australian aluminium extrusions industry in the form of price suppression, loss of profits, reduced profitability and reduced capital expenditure, as well drop in ROI. However, the results of the investigation determined no such subsidy had been offered to the exported products that could justify anti-dumping or countervailing duties.
