European Commission ends probe on Chinese aluminum foil export

The European Commission (EC) has terminated its investigation into the possible circumvention of anti-dumping measures on imports of certain aluminum foil originating in China, the EC said Wednesday.

Last October, the EC announced it had launched the investigation following a request lodged by EU producers Symetal, Eurofoil Luxembourg, Alcomet and Hydro Aluminium Rolled Products.

The product concerned was aluminum foil of a thickness of not less than 0.008 mm and not more than 0.018 mm, not backed, not further worked than rolled, in rolls of a width not exceeding 650 mm and of a weight exceeding 10 kg.

The EU producers' request "shows that a significant change in the pattern of trade involving exports from the People's Republic of China to the Union has taken place" following the imposition of definitive antidumping duties ranging from 6.4% to 30% on the product concerned in 2009, the EC said at the time.

As part of the inquiry, questionnaires were sent to nine exporting producers and to the authorities in China, but, neither the exporting producers nor the Chinese authorities came forward and submitted a questionnaire reply, the EC said. Questionnaires were also sent to 16 importers in the EU; only one importer came forward but did not submit a questionnaire reply.

Meanwhile, in April the four EU producers formally withdrew their request to investigate the possible circumvention of the existing measures, the EC said Wednesday.

The EC said it "considered that the present investigation should be terminated since the investigation had not brought to light any considerations showing that such termination would not be in the (EU) interest."
