
U.S. Customs and Border Protection (CBP) has determined that the Sun Bright International Corporation and Fair Importing Corporation entered merchandise covered by antidumping duty order A-570-967,1 and countervailing duty order C-570-968,2 into the customs territory of the United States by evading necessary duties. The CBP determined that these two companies imported aluminium extrusions from China to the U.S. by transshipping through Malaysia.
The Enforce and Protect Act (EAPA) investigation was conducted by CBP on a complaint filed by Aluminum Extruders Council (AEC).

Transshippers like these companies should know we will continue to locate and bring to justice those that seek to evade U.S. trade laws and the AEC’s aluminium extrusion orders against China.”
The customs report stated that they have got substantial evidence to support the claim that the importer has imported the aluminium extrusions from their supplier, CK Aluminium by submitting false statements thereby avoiding cash deposits applicable under AD/CVD orders.
The report also added that the aluminium extrusions declared by the importers to be of Malaysian origin, were actually Chinese-origin aluminium extrusions transshipped through Malaysia.
“Those importers and exporters that seek to undermine our orders will be caught and punished for circumventing U.S. law. Importers need to keep in mind that they will be held responsible for unpaid duties and possible fines,” Henderson added.
The extrusions are subject to the China-wide entity rate for the AD order on aluminium extrusions from China and the all other CVD orders on Chinese aluminium extrusions. These extrusions are liable for duties in excess of 90 per cent of the value of the merchandise. The report also said that all imported extrusions from CK Aluminum Malaysia and imported by these importers will be subjected to the tariff orders.
